This is the Terms of Service (TOS) for the BanniNation Chat (hereafter #banniNation or #bN).
First, let us thank Banned Ventures LLC for allowing us the link to chat on the site, and allowing us to use their wiki for dissemination of our information. This in no way is an indication that Banned Ventures LLC controls, or is liable, for the content and conduct of #banniNation.
And second, #banniNation has been created by notsuebhoney on the FDFnet IRC network, and therefore, has full and unconditional say in the rules as layed out below.
And finally, because of the nature of wiki, this document is only valid when edited by Notsuebhoney, Wepsi or Kitsune, or by additional persons that one of these three adds to this sentance in the future. All other changes are considered vandalisim. The edit history of this document is considered to be part of this document, to support the above claim.

[edit] Human Readable TOS
Here are the short and non binding Terms of Service. Please see "Legal Information" for the binding #banniNation Terms of Use. “We” in this case means #banniNation and all the ops supervising the channel.
- We're an IRC (Internet Relay Chat) channel on the FDFnet IRC network, and there are rules - using us means you'll play by the rules for #banniNation and FDFnet. There is no community moderation regarding #banniNation. Though we take our queues from the spirit of bannination.com, we are in no way affiliated with Banned Ventures, LLC.
- We may change the rules without notification and at our discretion, at any time.
- We don't give information on users, but if we are presented with legal court requests for discovery regarding your possible posting something illegal in chat, under United States law, where our servers are hosted, constitutes "we absolutely have to."
- You own your posts. We don't think it's fair that everything you post on the internet, you should automatically give up all right to. The only exception is if you create an original image or work that you place the "#banniNation" name in yourself and then post to the channel. Basically, we are treating that as a signature that you are expressly giving your work ("showing the love") to #banniNation and FDFnet.
- Since you own your posts, we assume you own all rights associated with your posts.
- We do our best to provide a network of people to assist in your enjoyment of #banniNation. However, with live interactive chat, some ugly things are bound to get through. Additionally, if you post anything that will knowingly get us in hot water; we are not taking the heat for you.
- Please assume all links in #banniNation are NSFW.
- Contact notsuebhoney with problems suebhoney at|symbol gmail dot com. Please put #banniNation in the subject line.
- We pride ourselves on being tolerant. However, in certain circumstances (eg - you being a total jackass to us) means we may either temporarily ban you from the channel until you calm down, or, gline (perma-ban) you from the network.
- Another exception is posting spam. Try it, and see how that works out for you. This includes anything we deem as spam. #banniNation's creators hate spam with a passion. Some links may trigger network spam filters that we have no control over, in an effort to combat spambots and scriptkiddies. If you see spam, report it to the channel @ops or the network, but do not repeat it, you may get taken out in the crossfire.

#banniNation is an IRC channel on the FDFnet IRC network for users to discuss issues and what have you in real time and service is subject to the following Terms of Use (hereafter referred to as "TOU"). By using #banniNation in any manner, you are agreeing to comply with the stated TOU. Should you object to the terms of this TOU, with #banniNation posting guidelines, or with any subsequent modifications of the TOU, your only recourse is to immediately discontinue use of #banniNation.

#banniNation reserves the sole right to change, modify, or alter these terms and conditions at any time for any reason at our discretion.

#banniNation is committed to your privacy. #banniNation does record the IP address of all users, but does not give out that information publicly. Please keep in mind that upon logging into the IRC channel, most IRC clients, including JPilot, will show your IP address. If you prefer that to be kept private, please do not use #banniNation or FDFnet.

All submissions, discussions, messages, text, files, and photos (.Posts.) posted on or through #banniNation, are the sole responsibility of the person or entity posting the content. #banniNation does not claim any rights or ownerships to such Posts EXCEPT images which contain the #banniNtion logo or name as part of the original Post. Images posted that contain the #banniNtion logo or name may not be reposted or broadcast without the express written consent of #banniNtion, and must attribute #banniNtion as the originator of such content.
You certify that you either own all copyright permissions, licenses, consents, and rights to the contents your Posts, or have obtained all copyright permissions, licenses, consents and rights to your Posts on #banniNation. You agree that you are solely responsible for your Posts. You agree that by placing your Post on #banniNation, you hereby grant #banniNation a non-exclusive, royalty-free license to display such content.
#banniNation does not permit the Posting of any personal information that is not expressly yours, or Posting trade-secret, defamatory, libel, slander, harassment, or imagery that can be deemed illegal or indecent by United States Federal law. Such Posts, if notified to or found by #banniNation will be considered a violation of TOU and, in appropriate circumstances, referred to legal authorities, if necessary.
#banniNation images linked in channel are not hosted on #banniNation servers, or even FDFnet's servers, and we urge the members of our community to alert the site hosting these images of any violation to copyright or image-legality issues.

Please provide the following in your material: A) You must have unaltered logs that can be checked against other logs of the ops of #banniNation. This ensures that no alterations were made. B) A statement as to why the content is problematic, including documentation of ownership in the event of copyright violation. C) A statement by you declaring, under penalty of perjury, that either you are or officially represent the harmed party by a Posting on #banniNation, and in the event of copyright violation, that you own or officially represent the copyright owner of offending content. D) An address, telephone number, and e-mail address for further communication.
#banniNation will reprimand, at our discretion, offending postings not permitted by the Content section of this TOU, and may ban the user for copyright postings subject to the procedures outlined in the Digital Millennium Copyright Act (DMCA), as the servers are located within the United States.

You agree that #banniNation, in its sole discretion, has the right to block your IP address at any time. #banniNation prides itself on being an open IRC channel for the discussion of ideas in the internet community and world at large. However, such actions including, but not limited to, unsolicited posting of marketing materials, violations of the TOU, or abuse of the users (again, at our discretion) are all grounds for temporary or permanent banning from #banniNation.
